NV Lifts 7 Year Scope

SB 409 was signed by the governor of Nevada last week. The new law, that takes effect immediately, removes the 7 year reporting requirement for pre-employment screening. Consumer Reporting Agencies can now reporting convictions regardless of how long ago they occurred.

The new law is very similar to the federal statutes that allow convictions to be reported that are older than 7 years, but non-convictions shall not be reported that pre-date 7 years from the disposition date.

It should be noted that records older than 7 years may not be readily available due to the courts purging their systems. It is strongly suggested that any Nevada employers that are updating their hiring policy, closely follow the new EEOC Guidelines.
